Acceptable Use Policy

Introduction

As a provider of web site hosting and other Internet-related services, Steady Communications, LLC offers its customer (also known as "Subscribers", "Client", "You", "User") and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. Steady Communications, LLC respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, Steady Communications, LLC reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, Steady Communications, LLC has developed Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement, and is intended as a guide to the customer's rights and obligations when using Steady Communications, LLC' services. This document will be revised from time to time.

1.1 - Disruption of Service

You may not disrupt the Service in any manner. You shall not interfere with computer networking or telecommunications services to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abuse of operator privileges or attempts to "crash" a host.

1.2 - Changes in Policy

Developments in the Internet, the law, our offerings and websites may cause us to change this Policy from time to time. Any such changes will be prospective and will not affect information collected prior to the change in policy.

1.3 - Viruses, Trojan Horses, Worms and Denial of Service Attacks

Software or other content downloaded from the Service may contain viruses and it is your sole responsibility to take appropriate precautions to protect your computer from damage to its software, files and data. You are prohibited from posting, transmitting or disseminating any information or software that contains a virus, Trojan horse, spambot, worm or other harmful program or that generates levels of traffic sufficient to impede others' ability to send or retrieve information. Prohibited conduct of this type includes denial of service attacks or similarly disruptive transmissions, as well as transmissions containing other harmful or malicious features. We may suspend your Service if we detect a harmful program in order to allow you to take measures to stop the harmful program.

1.4 - Prohibited Activities

You may not use the Service in a manner that violates any applicable local, state, federal or international law, order or regulation. Additionally, You may not use the Service to:

Conduct, participate in, or otherwise facilitate pyramid or other illegal soliciting schemes. Take part in any fraudulent activities, including impersonating any person or entity or forging anyone else's digital or manual signature. Invade another person's privacy, stalk, harass, or otherwise violate the rights of others. Post, transmit, or disseminate content that is illegal, threatening, abusive, libelous, slanderous, defamatory, promotes violence, or is otherwise offensive or objectionable. Restrict, inhibit, or otherwise interfere with the ability of any other person to use or enjoy the equipment or the Service, including, without limitation, by posting or transmitting any information or software which contains a virus, lock, key, bomb, worm, Trojan horse, cancelbot, or other harmful feature. Collect or store personal data about other users. Use an IP address not assigned to you. Violate any other Steady Communications, LLC policy or guideline.

1.5 - Misuse of Service

You are responsible for any misuse of the Service that occurs through your account or IP address. You must therefore take steps to ensure that others do not gain unauthorized access or misuse the Service.

1.6 - Traffic Usage

All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and bill $1.00 for each gig of traffic exceeded. This amount is not prorated, meaning that 1 mb - 1 gig will be treated and billed as the same.

1.7 - Proxy Services

We allow proxy services on our network. In case of abuse, Steady Communications, LLC reserves the right to ask the client to remove such offending material(s) if it is found to be responsible for network issues.

1.8 - IRC Services

We allow IRC services on our network. In case of abuse, Steady Communications, LLC reserves the right to ask the client to remove such offending material(s) if it is found to be responsible for network issues.

1.9 - Adult Content

We allow adult content as long as it remains in accordance with United States Laws. We DO NOT allow child pornography, or content deemed illegal within the United States

2.0 - Torrents

We DO NOT allow torrents to be used in our servers. Any user found to be in violation of this policy will result in the TERMINATION of the account.

2.1 - Server Abuse

Any attempt to undermine or cause harm to a server or customer of Steady Communications, LLC is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund.

2.2 - Additional Services & Management

Some of our services come un-managed by default. Which means that Steady Communications, LLC is not responsible for any management other than the initial operating system setup. Any work scheduled on an un-managed client's server will require a mendatory $25 fee per task. Managed clients are not responsible for any management if they signed up for a management package of $25 per month.

2.3 - Account Activation

By activating your account with Steady Communications, LLC, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

2.4 - Spamming

Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward Steady Communications, LLC, but also because it can overload Steady Communications, LLC' network and disrupt service to Steady Communications, LLC' subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, Steady Communications, LLC will investigate and shutdown the account that is SPAMing. A $250 charge for violating this policy will be charged to the person initiating the SPAM. Furthermore Steady Communications, LLC reserves the right to prosecute for this violation. A $1.00 charge will be assessed PER EMAIL sent should Steady Communications, LLC choose to pursue and prosecute.

2.5 - Audio / Video Streaming

Steady Communications, LLC allows the streaming of audio and videos as long as it does not disrupt any network activities and remains within legal boundaries. (IE: No streaming of copyrighted material).

2.6 - Obscene Speech or Materials

Using Steady Communications, LLC's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. Steady Communications, LLC is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

2.7 - Defamatory or Abusive Language

Using Steady Communications, LLC's network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language is strictly prohibited.

2.8 - Forging of Headers

Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message is prohibited.

2.9 - Illegal or Unauthorized Access to Other Computers or Networks

Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking") is prohibited. Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).

3.0 - Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities

Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.

3.1 - Facilitation a Violation of this TOS/AUP

Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this TOS/AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.

3.2 - Export Control Violations

Exporting encryption software over the Internet or otherwise, to points outside the United States are prohibited.

3.3 - NewsGroups

Steady Communications, LLC reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

3.4 - Other Illegal Activities

Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

Engaging in activities, whether lawful or unlawful, that Steady Communications, LLC determines to be harmful to its subscribers, operations, reputation, goodwill or customer relations.

3.5 - Copyrights & Trademarks

Client warrants that it has the right to use the applicable trademarks, if any, and grants Steady Communications, LLC the right to use such trademarks in connection with Steady Communications, LLC service.

3.6 - Right to Modify this Document

Steady Communications, LLC reserves the right to edit this document without any notification to customers. Customers are expected to regularly read this page in order to stay up to date with our Acceptable use policy.

3.7 - Report a Violation

We hope this AUP is helpful in clarifying the obligations of Internet users, including Steady Communications, LLC and its subscribers, as responsible members of the Internet. Any complaints about a subscriber's violation of this AUP should be sent to legal@steadcom.com
